1. Agreement to Terms

By creating an account on RISE, you (and, if you are under 13, your parent or guardian on your behalf) agree to these Terms of Service. These terms govern your use of the RISE application and related services operated by Polsia, Inc. ("RISE," "we," "us").

If you do not agree to these terms, do not use RISE.

2. Eligibility and Age Requirements

Who Can Use RISE

RISE is designed specifically for children ages 10–14. If you are outside this age range, RISE may not be appropriate for your needs.

Under 13 — Parental Consent Required

If you are under 13 years old:

A parent or legal guardian must provide verifiable consent before your account is activated
Your parent will receive a verification email and must click "Approve" before you can access RISE
Your parent can withdraw consent and request account deletion at any time

Ages 13–14

If you are 13–14, you may create an account without mandatory parental consent, though we strongly encourage parental involvement. Providing a parent email is optional but recommended.

⚠️ If we discover a user is outside the 10–14 age range or that an account was created without required parental consent, we will deactivate the account and delete the associated data.

3. Acceptable Use

You Agree To:

Use RISE honestly — challenges are for your real personal growth
Provide accurate information when creating your account
Keep your login email private and not share your account
Use kind, respectful language in any journal entries

You Agree Not To:

Create fake accounts or impersonate others
Attempt to access other users' accounts or data
Reverse-engineer, scrape, or attempt to extract data from RISE
Use RISE for any commercial purpose without our written permission
Attempt to circumvent the parental consent process
Submit journal entries containing threats, harassment, or harmful content

💡 Journal entries are private to you — parents and RISE staff cannot read them. But RISE reserves the right to act on reports of imminent harm to self or others.

4. Parent and Guardian Responsibilities

By approving your child's RISE account, you confirm:

You are the parent or legal guardian of the child signing up
You have read and agree to this Terms of Service and the Privacy Policy on your child's behalf
You consent to RISE collecting the data described in our Privacy Policy
You are responsible for your child's compliance with these terms

You have the right to review, correct, or delete your child's data at any time by contacting privacy@polsia.app.

5. Account and Data

Your Data, Your Rights

All challenge completions, journal entries, skill progress, and profile data belong to you. You have the right to:

Export — Request a copy of all data we hold for you
Correct — Request corrections to inaccurate data
Delete — Request full deletion of your account and all associated data

Account Deletion

To delete your account and all data:

Email privacy@polsia.app with subject "Delete My Account"
We will confirm and complete deletion within 30 days

6. Intellectual Property

RISE, including its challenges, design, code, and content, is the property of Polsia, Inc. and protected by copyright. You may not copy, reproduce, or distribute RISE content without our written permission.

Your journal entries and personal reflections belong to you. We claim no ownership over what you write.

7. Free Tier and Pro Subscription

Free Tier

RISE offers a free tier with access to daily challenges and core progress tracking. The free tier is always available and will not be removed without advance notice.

RISE Pro ($4.99/month)

Pro subscribers unlock advanced features including expanded skill trees and progress analytics. Subscriptions are billed monthly and can be cancelled anytime.

Refunds

If you experience a technical issue that prevents you from using RISE Pro, contact privacy@polsia.app within 7 days of the charge for a full refund.

8. School and Classroom License (FERPA Compliance)

Schools and Districts

Schools and educational institutions may use RISE under a classroom or institutional license. Under this arrangement:

The school operates as the data controller for student accounts created through the institution
Schools may obtain parental consent on behalf of parents under FERPA
Student data collected through school accounts is treated as educational records under FERPA
We do not use student data from school accounts for advertising, analytics sold to third parties, or any purpose beyond operating RISE for that institution
Schools have the right to audit, export, and delete all student data upon request

FERPA Compliance

RISE will not disclose students' educational records without consent from the school and/or parents, except as required by law. We comply with all applicable provisions of the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g.

9. Disclaimers

RISE is a personal development tool designed to support resilience-building in young people. It is not:

A mental health treatment or therapy service
A substitute for professional counseling, therapy, or medical advice
A crisis intervention service

RISE is provided "as is" without warranties of any kind. We do not guarantee continuous availability, and we may update or discontinue features with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, Polsia, Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from use of RISE. Our total liability for any claim is limited to the amount paid by you in the 12 months preceding the claim (or $10, whichever is greater, for free-tier users).

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Disputes will be resolved through binding arbitration in accordance with the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations.

Class action waiver: You agree to resolve any dispute individually and not as part of a class action.

12. Changes to Terms

We may update these Terms. For material changes affecting children's accounts, we will notify parents by email and require re-acknowledgment. Continued use of RISE after notification constitutes acceptance of the updated Terms.
